Ombudsman Morales: ‘Suspension kay Carandang unconstitutional, ‘di ko susundin’

Mariing kinontra ni Ombudsman Conchita Carpio-Morales ang 90-day preventive suspension order na iniutos ng Office of the President laban kay Overall Deputy Ombudsman Arthur Carandang.

Sa inilabas na pahayag ni Morales, binigyang diin nito na paglabag umano sa Saligang Batas ang nais ni Duterte.

Tinukoy pa nito ang nakapaloob sa Supreme Court ruling noong 2014 na nagsasaad na walang administrative disciplinary jurisdiction ang pangulo laban sa deputy ombudsmen.

“In Gonzales III (vs Office of the President – G.R. No. 196231, 28 January 2014) the Supreme Court categorically declared unconstitutional the administrative disciplinary jurisdiction of the President over deputy ombudsmen,” giit ni Morales.

Ani Morales, insulto sa kanyang tanggapan ang utos ng Pangulo, kung kaya bilang Ombudsman ay hindi raw nito hahayaang malagay sa alanganin ang mga opisinang sinumpaan niyang poprotektahan.

“Like any government official, the Ombudsman has sworn to uphold the Constitution and the laws of the land. The Ombudsman cannot, therefore, seriously place at risk the independence of the very Office which she has pledged to protect on the strength of the constitutional guarantees which the High Court has upheld.”

Kung maaalala, ipinag-utos ng tanggapan ng Pangulong Duterte ang suspensyon ni Carandang kasunod nang paglalabas nito ng mga umano’y record ng bank account ng chief executive.
